Terms for the SpeedTest website and iPhone app.

1. Service
SpeedTest provides informational network measurements, diagnostic checks, guides, and related utilities. Features may change, be limited, or become unavailable.
2. Measurement limitations
Results are estimates, not a certification or guarantee. They vary with device capability, browser behavior, Wi-Fi conditions, cellular conditions, background traffic, routing, test endpoint load, VPNs, relays, and internet plan. HTTPS response time is not identical to ICMP ping or in-game latency. LAN Scan cannot guarantee discovery of every connected device.
3. Acceptable use
You may use SpeedTest for lawful personal or business network evaluation. You must not use it to disrupt services, bypass access controls, scan networks without authorization, interfere with other users, reverse engineer protected components except where law permits, or violate applicable law or third-party rights.
4. Data usage and charges
Speed tests transfer data. You are responsible for mobile data charges, provider limits, roaming charges, and any other costs associated with your connection. Avoid repeated tests on a metered plan unless you understand the impact.
5. Third-party services
SpeedTest relies on or interacts with independently operated services, including Cloudflare, ipwho.is, Apple Maps, the App Store, and hosts you test. Those services may change, limit access, become unavailable, or apply their own terms and privacy policies. We do not control them.
6. No affiliation
References to games, platforms, network providers, or other products identify test destinations or compatibility. No sponsorship, endorsement, or affiliation is implied. Third-party names and marks belong to their respective owners.
7. Intellectual property
The Website, App, original interface, branding, and original content are owned by the developer or licensors and protected by applicable law. These Terms grant a limited, revocable right to use the service; they do not transfer ownership.
8. Availability
We may modify, suspend, or discontinue features without notice. Test providers and destinations can impose limits or outages outside our control. We do not promise continuous or error-free availability.
9. Disclaimer
To the fullest extent permitted by law, SpeedTest is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation. Mandatory consumer rights remain unaffected.
10. Limitation of liability
To the fullest extent permitted by law, the developer is not liable for indirect, incidental, special, consequential, or punitive damages; data loss; lost profits; service interruption; provider charges; or decisions made from measurements. Where liability cannot be excluded, it is limited to the minimum allowed by law.
11. Apple App Store terms
If you obtained the App through Apple’s App Store, these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support and, to the extent permitted by law, no warranty obligation for the App. Apple is a third-party beneficiary of these Terms and may enforce them. Your use must comply with App Store rules.
12. Changes and governing law
We may update these Terms. Continued use after publication means you accept the revised Terms. They are governed by laws applicable to the developer, excluding conflict-of-law principles, except where mandatory law in your place of residence applies.
